Solicitor’s Office says Joshua Darby must serve at least 85% of his sentence under South Carolina law

CONWAY, SC — A Murrells Inlet man has been sentenced to 10 years in prison after pleading guilty Tuesday to fentanyl distribution and domestic violence charges, according to Fifteenth Circuit Solicitor Jimmy Richardson.

Joshua Markees Darby, 38, pleaded guilty to second‑offense distribution of fentanyl and second‑degree domestic violence, said Assistant Solicitor Corey Toney, who prosecuted the case.

Circuit Court Judge Benjamin Culbertson handed down the 10‑year sentence. Under South Carolina law, Darby must serve at least 85% before becoming eligible for supervised release. Prosecutors noted that the fentanyl charge – a subsequent offense – is classified as a serious crime and will count as a strike under the state’s three‑strike law.

The drug charges stem from controlled narcotics buys conducted by Horry County Police Department Narcotics Unit detectives during March, April, and May 2025 in the Myrtle Beach area. The domestic violence charge followed a June 2025 incident in which officers responded to a disturbance and found the victim with visible injuries. Darby attempted to flee but was detained at the scene.

“The Solicitor’s Office would like to thank both officers with the Narcotics Unit and the Horry County Police Department for their diligent work on this case,” Toney said.
