By BC News Staff Writer

Southport, NC — Southport Alderman Robert Carroll will face a new review of his 2023 DWI charge after a Brunswick County prosecutor filed an appeal seeking to reinstate the case.

According to court records, Assistant District Attorney Jason Minnicozzi submitted the appeal on June 12, sending the matter to Brunswick County Superior Court for a de novo hearing. The district court dismissed the charge in May, citing procedural issues.

A quick explainer for readers de novo hearing means the case is reviewed from the beginning, as if the earlier ruling never happened. The Superior Court evaluates the evidence and arguments afresh, without relying on the district court’s dismissal.

Carroll was arrested in Boiling Spring Lakes after officers reported a 0.21 blood‑alcohol concentration, more than twice the legal limit. He continues to serve on the Southport Board of Aldermen.

As of June 13, he has not issued public comment regarding the appeal.
