ASH, NC — A wrongful‑death and medical‑malpractice lawsuit has been filed against Brunswick Health & Rehab in Ash, according to public court records filed in Brunswick County Superior Court.
The complaint, submitted on June 8, names Brunswick Health & Rehab, LLC and Autumn Corporation as defendants. The suit was filed by Frank Phelps III, whose mother, Anne Phelps, 76, lived at the 100‑bed skilled‑nursing facility following a stroke.
According to the filing, Phelps had multiple chronic medical conditions and required close medical supervision. Public records state that beginning in May 2024, the facility allegedly failed to properly monitor an infection, address hydration concerns, and follow established care‑plan measures related to fall risk. The lawsuit claims these lapses contributed to her decline and death.
Brunswick Health & Rehab is licensed by the North Carolina Department of Health and Human Services. No regulatory findings related to the lawsuit have been released, and the facility has not issued a public statement.
The lawsuit seeks damages for alleged negligence, medical malpractice, and wrongful death. As of Thursday, no hearing dates have been scheduled.
